The UN accuses Israel of destroying the reproductive capacity of Palestinians in Gaza.

In a report released Thursday, the UN Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem and Israel, accused Israel of carrying out “genocidal acts” against Palestinians by systematically destroying women’s healthcare facilities in Gaza and using sexual violence as a strategy of war.

The report argues that Israeli authorities have partially destroyed the reproductive capacity of Palestinians in Gaza as a group, including by imposing measures aimed at preventing births. These actions, according to the Commission, constitute a category of genocidal acts under the Rome Statute and the Genocide Convention. Furthermore, the increase in maternal deaths due to restricted access to medical supplies is considered a crime against humanity: extermination.

Israeli security forces were also accused of using forced public nudity and sexual assault as part of their standard operating procedures to punish Palestinians following Hamas-led attacks in southern Israel in October 2023.

Israel rejects accusations

Israel's Permanent Mission to the UN in Geneva categorically rejected the accusations, calling them "baseless, biased, and lacking credibility." In a statement, Israel maintained that the Israel Defense Forces (IDF) has concrete directives and policies that unequivocally prohibit such conduct and that its review processes are aligned with international standards.

The UN Commission's report follows another published in June 2024 that accused Hamas and other Palestinian armed groups of serious human rights violations during the October 7, 2023, attack, which included torture and degrading treatment.

Israel, as a party to the Genocide Convention, was instructed by the International Court of Justice in January 2024 to take measures to prevent acts of genocide during the war against Hamas. However, Israel is not a party to the Rome Statute, which grants the International Criminal Court jurisdiction to rule on individual cases of genocide and crimes against humanity.

Meanwhile, South Africa has filed a genocide case against Israel at the International Court of Justice, amid a war that, according to the Hamas-controlled Gaza Health Ministry, has claimed the lives of more than 48,000 Palestinians since Hamas's attack on Israel left 1,200 dead and 251 hostages.
